Arizona Evangelist Challenges Tucson Festival Restrictions in Religious Freedom Lawsuit

CNIR — Christian News & Investigative Reports

TUCSON, Ariz. — An Arizona Christian evangelist has sued Tucson and two police officers, alleging authorities threatened him with arrest for discussing his faith and distributing Gospel literature during the Winterhaven Festival of Lights.

David Hoffman filed the federal civil rights complaint October 2, 2026, in the U.S. District Court for the District of Arizona. The lawsuit challenges restrictions enforced during the December 2025 event and seeks protection for religious expression at future festivals.

Religious Conversations at Issue

According to the complaint, Hoffman attended the neighborhood festival to speak with willing listeners about Christianity and offer religious materials. His attorneys describe the celebration as a free public gathering conducted along neighborhood streets and pedestrian routes.

Hoffman alleges police instructed him to stop religious expression within the festival boundaries or move to a designated area outside the main event. He contends that officers repeatedly threatened arrest if he continued speaking about his beliefs or handing out leaflets inside.

The complaint argues that the location assigned for expression separated Hoffman from his intended audience and substantially limited opportunities for personal conversations. These assertions represent the plaintiff’s allegations, rather than findings established by a court.

Attorneys Seek Court Intervention

First Liberty Institute represents Hoffman alongside attorneys from Gibson, Dunn & Crutcher and Holtzman Vogel. The legal team announced October 8 that it had sought a preliminary injunction to protect his participation in the upcoming December festival.

His lawyers maintain that allowing an event on public streets does not authorize officials to exclude protected religious viewpoints. The complaint invokes federal constitutional protections and Arizona law while requesting declaratory relief, injunctions and nominal damages.

Tucson Declines Comment

Tucson declined to discuss pending litigation, according to Fox News Digital reporting republished by the New York Post. That report said police had not immediately answered its request for comment.

For churches and evangelists conducting public outreach, the dispute highlights questions about access to community events and the enforcement of speech restrictions. Hoffman is asking the court to determine whether Tucson’s actions unlawfully restricted his ministry; the lawsuit itself does not establish constitutional wrongdoing by the named defendants.
